Welcome to flamingo.tm. By accessing or using our tour management platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. The Service

flamingo.tm is a tour management platform that helps musicians, tour managers, and their teams organise tour itineraries, budgets, day sheets, advance requests, guest lists, and related logistics. The Service is provided via a web application and a companion mobile app.

2. Accounts

You must create an account to use flamingo.tm. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account.

You may sign up using an email and password or through Google OAuth. You must be at least 16 years of age to use the Service.

3. Subscriptions & Payment

flamingo.tm offers subscription plans with varying features. Payments are processed securely through Stripe. By subscribing, you authorise us to charge your chosen payment method on a recurring basis until you cancel.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods.

We offer a 14-day free trial for new users. No payment is required during the trial period.

4. Your Content

You retain ownership of all data and content you upload to flamingo.tm, including tour details, budgets, documents, images, and files. By using the Service, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the Service to you and your team.

You are responsible for ensuring you have the right to upload any content and that your content does not violate any applicable laws or third-party rights.

5. Team Collaboration

flamingo.tm allows you to invite team members to tours and projects. When you invite someone, they will be able to view and interact with shared tour data based on their assigned role and permissions. You are responsible for managing access to your tours and projects.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Interfere with or disrupt the Service or servers connected to it
• Upload malicious code, viruses, or other harmful content
• Resell, redistribute, or sublicense access to the Service without our written consent

7. Advance Requests & Guest Lists

The Service allows you to send advance requests to venues and manage guest lists for events. You are solely responsible for the accuracy of the information you send through these features and for ensuring you have authority to manage guest lists for the relevant events.

8. Availability & Modifications

We strive to keep flamingo.tm available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of significant changes.

9. Limitation of Liability

To the fullest extent permitted by law, flamingo.tm and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. You may delete your account at any time by contacting us.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting a notice on the platform or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
